AGENDA ITEM: Resolution Approving the Purchase of a Ferric Chloride Feed System to Remove Arsenic from Well 17.

RECOMMENDATION:

Approve Resolution No. 2018-_ approving the purchase of a Ferric Chloride Feed System from Loprest to remove Arsenic at Well 17 that will consist of the following:

1. (one) Prominent Dual Gamma X metering pump skid;

2. (one) Poly Processing Safe Tank, 405 gallons w/ dual containment and seismic tie-down;

3. (one) Flowline LU27-40 Echo sonic level transmitter;

4. (one) Programming and start up service.

BACKGROUND AND DISCUSSION:

Well 17 was designed with a filter system to remove Manganese and Arsenic (if needed) from the groundwater. At the time the well was constructed, the filter system was set up to remove Manganese only because groundwater exceeded the Manganese MCL. The filter system was also set up with pads, stubouts, electrical controls and programing to incorporate a Ferric Chloride Feed System in the future to aid in the removal of Arsenic from the groundwater. Within the last two months, Arsenic concentrations have increased above the MCL of 10 ppb ranging from 11 to 13 ppb. Should the Arsenic concentrations remain in the 11 – 13 range, it will put Well 17 out of compliance with the Arsenic MCL. Implementation of the Ferric Chloride Feed System at Well 17 will keep the Arsenic levels below the MCL keeping the City in compliance with the Arsenic MCL.

The filter system at Well 17 was provided by Loprest. Loprest designed the Ferric Chloride Feed System to work in conjunction with the filters to remove Arsenic from the groundwater supplied by Well 17. Staff recommends that Loprest furnish the Ferric Chloride Feed System and program the addition of this new equipment for the removal of Arsenic at Well 17. The use of other vendors would significantly increase the programming cost for this project due to the lack of experience and familiarity with the existing system. Having Loprest complete the work would also keep the existing system consistent with manufacturer models and programming standards. Loprest has provided a quote to furnish and integrate/program the system for $28,733.34.

The City’s forces will provide the labor to unload, put in place, and hard connect the new equipment to the existing system.

FISCAL IMPACT:

The purchase and installation of the Ferric Chloride Feed System will be 100% funded from the Water Enterprise fund from the approved 2017/18 budget.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON APPROVING THE PURCHASE OF A FERRIC CHLORIDE FEED SYSTEM TO REMOVE ARSENIC FROM WELL 17

WHEREAS, Well 17 was designed with a filter system to remove Manganese and Arsenic (if needed) from the groundwater; and

WHEREAS, Well 17 was initially constructed to remove Manganese only and was set up with the ability to remove Arsenic in the future should the Arsenic concentrations increased above the Arsenic MCL; and

WHEREAS, during the last two months, Arsenic concentrations at Well 17 have increased above the MCL of 10 ppb ranging from 11 ppb – 13 ppb; and

WHEREAS, should the Arsenic concentrations remain in the 11 ppb – 13 ppb range, Well 17 will be out of compliance with the Arsenic MCL; and

WHEREAS, implementation of the Ferric Chloride Feed System at Well 17 will keep the Arsenic levels below the MCL keeping the City in compliance with the Arsenic MCL; and

WHEREAS, the filter system was provided by Loprest; and

WHEREAS, as part of the Well 17 Project, Loprest designed the Ferric Chloride Feed System to work in conjunction with the filters to remove Arsenic from the groundwater supplied by Well 17; and

WHEREAS, the City desires to enter into a contract with Loprest to furnish and program the Ferric Chloride Feed System at Well 17 for the removal of Arsenic; and

WHEREAS, Section 1-11 et seq. of the Livingston Municipal Code set forth the City of Livingston’s Purchase Policies and Procedures and established that purchases of operational supplies, materials, and equipment in excess of Ten Thousand Dollars ($10,000) be subject to formal bidding, which is consistent with the California Public Contract Code; and

WHEREAS, Section 1-11-6 provides that formal bidding requirements for purchases may be waived if a purchase is: of urgent necessity for the preservation of life, health or property; exempted by Council resolution passed by at least four (4) affirmative votes; or only available from one (1) source; and

WHEREAS, the use of other vendors for the implementation of the Ferric Chloride Feed System would significantly increase the programming cost for this project due to the lack of experience and familiarity with the existing system; and

WHEREAS, having Loprest complete the Ferric Chloride Feed System would keep the existing system consistent with manufacturer models and programming standards; and

WHEREAS, the Council approval of the implementation of the Ferric Chloride Feed System at Well 17 will remove the Arsenic from the groundwater and meet the State drinking water standards.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Livingston as follows:

1. Approve the purchase of the Ferric Chloride Feed System quoted by Loprest.

2. The purchase of the Ferric Chloride Feed System and programming work for Well 17 is exempt from formal bid procedures pursuant to Section 1-11-6 of the Livingston Municipal Code.

3. The City Manager is hereby authorized and directed to procure the Ferric Chloride Feed System from Loprest for the quoted price of $28,733.34.
