RECOMMENDATION:

Adopt Resolution No. 2018-_, terminating the 2005 RTIF Implementation Agreement authorizing MCAG to manage and administer the RTIF Program dated August 1, 2005, and adopting the RTIF Update Study dated December 15, 2016, and associated background project list.

BACKGROUND:

On August 1, 2005, the City of Livingston entered into an Implementation Agreement authorizing the MCAG to manage and administer the RTIF Program. The RTIF Program provides a fair and equitable method for distributing unfunded costs of transportation improvements necessary to accommodate traffic volumes generated by new development within the cities and Merced County to the year 2030.

DISCUSSION:

At the January 18, 2018 MCAG Governing Board meeting, the MCAG Governing Board proposed that the member jurisdictions with MCAG RTIF Implementation Agreements act to rescind their RTIF projects. The MCAG Governing Board also acted to tentatively approve a method for distributing remaining RTIF funds assuming the RTIF Implementation Agreements are terminated by every participating jurisdiction. The fund distribution method tentatively approved would distribute remaining funds to each jurisdiction based on that jurisdiction’s contributions. Distributed RTIF funds would only be eligible on projects from the December 15, 2016 RTIF Study and associated regional project list. MCAG tentatively approved the fund distribution method and additional action by the MCAG Governing Board will be required.

RESOLUTION NO. 2018-

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON TERMINATING THE 2005 REGIONAL TRANSPORTATION IMPACT FEE (RTIF) IMPLEMENTATION AGREEMENT, AND ADOPTING THE 2016 RTIF UPDATE STUDY AND PROJECT LIST

WHEREAS, the City of Livingston entered into an Implementation Agreement on August 1, 2005, authorizing the Merced County Association of Governments (MCAG) to manage and administer the Regional Transportation Impact Fee (RTIF) program; and

WHEREAS, the RTIF program provides a fair and equitable method for distributing unfunded costs of transportation improvements necessary to accommodate traffic volumes generated by new development within the Cities and Merced County to the year 2030; and

WHEREAS, the agreement, attached herein as Exhibit A, is Contract No. 2005-080 and titled “Implementation Agreement Authorizing the Merced County Association of Governments to Manage and Administer the Regional Transportation Impact Fee Program”; and

WHEREAS, the MCAG Governing Board held a meeting on January 18, 2018, and moved to request that all member jurisdictions terminate the 2005 Implementation Agreement and to consequently adopt their accepted 2016 RTIF Update Study and associated project list, dated December 15, 2016 (Exhibit B); and

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Livingston, that:

1. The City C o u n c i1 consents to the termination of the Implementation Agreement Authorizing the Merced County Association of Governments to Manage and Administer the Regional Transportation Impact Fee Program, Contract No. 2005-080; and

2. The 2016 Regional Transportation Impact Fee (RTIF) Update Study, including the list of updated regional projects, is hereby approved and adopted.
