RECOMMENDATION:

City Council adopt Resolution No. 2018-_, updating the Livingston Police Department Records/Animal Fees Table

BACKGROUND AND DISCUSSION:

The City charges a variety of fees for various services provided by the Police Department when related to records, vehicle releases, fingerprint cards, and traffic reports. The fee schedule currently used is outdated and does not allow the city to recoup the costs associated with providing the service. The fees are not intended to generate revenue, but to be brought up to date and more aligned with other jurisdictions.

The current vehicle release fees for example for are outdated and charged differently dependent on the reason for tow/impound. They range from $80 or $125 whereas other cities simply charge one fee. Our fees need to be increased to ensure all associated staff work is reflected and recouped. In comparison, our agency charges $80 for a tow which requires work to enter a vehicle and all its information into CLETS. Currently, Atwater Police Department charges $216, San Jose Police Department charges $252, and Elk Grove Police Department charges $170.

Another example which reflects an outdated fee structure are the report fees. By law, an agency cannot charge for the first 10 pages of a crime report, after the agency may charge 10 cents a page. In regards to collision reports, agencies may charge a fee, however Livingston Police has never done so. Charging a fee for collision reports is common practice, especially since the Insurance companies are paying for a report to assess insurance claims. Police agencies charge anywhere from $15 to $75 per report to cover the costs of locating reports and making copies.

Updating the proposed fee schedule would allow our police department to recover the costs associated with the service. The only animal fee to be updated is the removal of a fee to pick up dead animals at a private residence. In these cases, the animal owners are not referred to the animal shelter.

FISCAL IMP ACT:

The proposed fees will more closely cover the costs of providing these services and be more in line with other local jurisdictions.

RESOLUTION NO. 2018-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVINGSTON UPDATE POLICE DEPARTMENT RECORDS/ANIMAL FEES

WHEREAS, the City has established records and animal fees to cover the cost of providing various records and animal services, including, but not limited to, vehicle releases, providing copies of collisions reports, and providing fingerprinting service; and

WHEREAS, from time to time the City needs to update the records/animal fees to more closely align with the costs of providing these services; and

WHEREAS, the City has not updated records fees for over 10 years; and

WHEREAS, the City has performed an analysis and regional comparison and has developed a set of new fees to more closely cover the costs of providing Records/Animal services.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Livingston does hereby adopt new Records/Animal fees as shown on attachment #3 marked proposed fee schedule.
