RECOMMENDATION:

Staff recommends that the City Council (1) deny the claim for damages from Yessenia Garcia; (2) submit the claim to AIMS, the City’s insurance adjustors, for review and processing; and (3) direct staff to send a letter to the claimant advising of the City’s denial of the claim.

BACKGROUND:

On June 19, 2018, the City received a claim from Yessenia Garcia alleging damages sustained to her vehicle on Walnut Avenue and Franci Street, Livingston, involving the Livingston Public Works Department.

DISCUSSION:

Ms. Garcia alleges that a tar substance used by Public Works employees for crack sealing stuck to all four (4) tires of her vehicle which then caused her vehicle to shake. She was told by her mechanic that the tar cannot be removed and all four (4) tires must be replaced.

FISCAL IMPACT:

Unknown at this time. Total cost to the City will be determined after review by the AIMS office.
